1. Acceptance of Terms

By accessing and using EnergyAPI services ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

EnergyAPI provides real-time, historical, and forecasted European energy pricing data through industrial protocols including Modbus TCP/RTU, OPC-UA, and REST APIs. The service is designed for integration with PLCs, SCADA systems, and other industrial automation equipment.

3. User Accounts and Registration

3.1 Account Creation

To use our services, you must:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3.2 Account Types

We offer different subscription tiers:

• Trial: Limited access for evaluation purposes
• Starter: Basic access with device and request limits
• Professional: Advanced features with higher limits
• Enterprise: Custom solutions for large-scale operations

4. API Usage and Limitations

4.1 API Keys

API keys are provided for server-to-server communication:

• Keep API keys secure and confidential
• Do not share keys in publicly accessible code
• Report compromised keys immediately
• Keys may be regenerated at your request

4.2 Usage Limits

Usage is subject to plan limitations:

• Request limits per month
• Number of connected devices
• Rate limits per minute/hour
• Data retention periods

Excessive usage may result in temporary throttling or account suspension.

5. Billing and Payment

5.1 Subscription Fees

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law.

5.2 Payment Methods

We accept major credit cards and bank transfers. You authorize us to charge your payment method for all fees incurred.

5.3 Late Payments

Late payments may result in service suspension. A €25 fee applies to reactivated accounts after suspension.

5.4 Price Changes

We may change pricing with 30 days notice. Price changes affect renewals, not current billing periods.

6. Data and Content

6.1 Energy Data

Energy pricing data is sourced from ENTSO-E and other official sources. While we strive for accuracy, we do not guarantee data completeness or real-time availability.

6.2 Data Usage

You may use the data for industrial automation and energy management purposes. Redistribution or commercial resale requires written permission.

6.3 Data Retention

Historical data is retained according to your plan. Data may be purged after account termination.

7. Prohibited Uses

You agree not to:

• Use the service for illegal activities
• Attempt to reverse engineer or compromise the service
• Share account credentials or API keys
• Exceed usage limits intentionally
• Transmit malicious code or viruses
• Interfere with other users' access
• Use automated tools to access the service without permission
• Resell or redistribute data without authorization

8. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. Maintenance windows and outages may occur. We provide status updates at status.energyapi.eu.

9. Termination

9.1 By You

You may terminate your account at any time. Termination takes effect at the end of the current billing period.

9.2 By Us

We may terminate or suspend your account for violations of these terms, non-payment, or other reasonable grounds.

9.3 Effect of Termination

Upon termination, your access ceases immediately. We may retain data as required by law.

10. Disclaimers and Limitations

10.1 Service Disclaimers

The service is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied.

10.2 Limitation of Liability

Our total liability is limited to the amount paid for the service in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10.3 Data Accuracy

While we source data from reliable providers, we do not guarantee accuracy, completeness, or timeliness of energy pricing data.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the service or violation of these terms.

12. Intellectual Property

The service and its original content are protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without permission.

13. Governing Law

These terms are governed by Dutch law. Any disputes shall be resolved in the courts of Amsterdam, Netherlands.

14. Changes to Terms

We may modify these terms with reasonable notice. Continued use after changes constitutes acceptance. Major changes will be communicated via email.
